AUSTRALIAN FOOTBALL LEAGUE NAB AFL AUSKICK AND NAB AFL SUPERKICK TERMS AND CONDITIONS OF PARTICIPATION

Your child’s completed Registration Form and these Terms and Conditions of Participation (which may be amended by the Australian Football League (AFL) from time to time by uploading updated Terms and Conditions of Participation to the AFL website at play.afl/terms-of-participation-players) (Terms and Conditions) are the conditions upon which you agree to allow your child to participate in the NAB AFL Auskick program or NAB AFL Superkick Program as described at play.afl/auskick, play.afl/superkick.

NAB AFL Auskick program and NAB AFL Superkick Program will be referred to as Program when they are interchangeable within the context.

The Program is delivered differently depending on the specific format for which your child registers to participate. Depending on the Program format, the benefits your child will receive may vary (Participant Benefits) and there may be other differences such as session duration and season length, which will be outlined at the time of registration. The minimum number of sessions and Participant Benefits for each Program format is set out in item 3 of these Terms of Participation.

1. Safeguarding Children and Young People

(a) The AFL is committed to promoting and protecting the safety and wellbeing of children and young people in the AFL’s care who are involved in the Program. The AFL has published its Safeguarding Children and Young People PolicyCode of Conduct and Reporting Procedure (https://www.afl.com.au/policies).

(b) The AFL requires that all parents, guardians and other spectators associated with the AFL and related AFL State and Territory entities:

  • understand and comply with the AFL Parents, Guardians and Spectators Code of Conduct as set out at item 9 of these Terms and Conditions;
  • when necessary, politely and respectfully remind others of their obligations under the Parents, Guardians and Spectators Code of Conduct; and
  • in the event of serious or ongoing breaches of the Parents, Guardians and Spectators Code of Conduct by another person, to report the matter to a ground or club official so that appropriate action can be taken.

(c) If parents, guardians or other spectators witness or have a concern regarding child abuse, they must report this on the AFL’s safeguarding children and young people reporting platform (https://eafl.austfoot.com.au/afl-makeareport/#/landing) or to an appropriate person involved in the Program.

2. Application to participate

(a)     You must, for each child you are registering in the Program:

        (i) complete the online form relevant to your chosen program (https://www.play.afl/play/club-finder/);

        (ii) pay a fee to the AFL by completing the online credit card section during an online registration (Fee);

        (iii) agree that your child understands the Player Code of Behaviour (as set out at item 8 of these Terms and Conditions);

        (iv) agree that you understand and will comply with the Parents, Guardians and Spectators Code of Conduct (as set out at item 9 of these Terms and Conditions),

(the Application).

(b)     You warrant that for each child that you submit an Application for:

         (i) the child is between 5 and 12 years old (inclusive) during their participation in the Program, or if aged 4 at the time of Application, will turn 5 within the same calendar year. You agree to provide proof of age if requested by the AFL; and

        (ii) the child does not have any known medical or other condition that would make participation in the Program unsafe. If requested by the AFL, you agree to provide a medical certificate confirming the child is fit to participate.

(c)     Subject to item 2(d) below, the AFL will:

        (i) process and accept Applications until all places in the specified Program are filled; and

       (ii) send you an email from PlayHQ (notifications@playhq.com) confirming the child’s acceptance and registration in the Program.

(d)     The AFL will not:

       (i) process any Application that is incomplete, unclear, or is not accompanied by the Fee; or

      (ii) accept any changes to the Application, except for a change of email address or phone number.

3. Participant Benefits and number of sessions

(a)     Once an Application is accepted and the associated Fee paid to the AFL in accordance with item 2(a)(ii), the registered child will receive the relevant Participant Benefits applicable to the specific Program format for which the child has registered to participate. The method of delivery and nature of these benefits will vary depending on the Program, as outlined below:

       (i) Community Program (Auskick and Superkick): Participants registered in a Community Program will be mailed their Program benefits pack to their nominated postal address.

      (ii) School Program (Auskick and Superkick): Participants may receive a Program benefits pack that will generally be handed out by the relevant Program Coordinator or staff member during the course of the program. In
some circumstances, the benefits pack may be mailed. Certain School Programs may also be aligned to an AFL Club, and in such cases, and the benefits pack items may contain items that are branded accordingly.

     (iii) Introductory Program (Auskick only): Participants registered in the Introductory Program should note that this format is simplified and, in most instances, does not include the provision of an Auskick benefits pack.

     (iv) Other/Modified Program (Auskick and Superkick): Participants may receive a Program benefits pack that will be handed out by the relevant Program Coordinator or staff member, or, in the case of certain Auskick or Superkick Programs, the pack may alternatively be mailed to the participant’s nominated postal address.

     (v) Holiday Program (Auskick and Superkick): Participants registered in a Holiday Program will generally receive a Program benefits pack that will be handed out by the relevant Program Coordinator or staff member during the program.

(b) The AFL may, in its discretion, substitute any pre-advertised items in the Participant Benefits pack with items of similar value.

(c)     Each Auskick Program will consist of a minimum number of sessions as follows:

        (i) Auskick Community Program: 8 sessions,

       (ii) School Program, Introductory Program, Modified/Other Program: 4 sessions,

      (iii) Holiday Program: 1 session,

(Auskick Minimum Session Commitment)

Additional sessions may be provided above the Auskick Minimum Session Commitment at the discretion of the Program coordinators, and this will be communicated with you at the time of registration.

(d)     Each Superkick Program will consist of a minimum number of sessions as follows:

        (i) Superkick Community/Community (Club) program: 6 sessions.

       (ii) School Program, Introductory Program, Modified/Other Program: 4 sessions;

      (iii) Holiday Program: 1 session,

(Superkick Minimum Session Commitment)

Additional sessions may be provided above the Superkick Minimum Session Commitment at the discretion of the Program coordinators

4. Limitation of Liability and Release

You understand that there are inherent risks associated with participation in the Program, which may result in personal injury (even of a serious nature) to a child and that you fully accept and agree to bear those risks.

(a)     You agree not to bring any claim, demand, action or proceeding against the AFL or its related bodies corporate (which shall include its directors, employees, agents and volunteers) for any damage, loss or injury whatsoever that you or a child may suffer from participation in the Program.

(b)     The AFL’s liability to you (including that of its directors, employees, agents and volunteers) is limited (at the AFL’s election) to the AFL repaying any amounts paid by you under these Terms and Conditions to the AFL or supplying or resupplying any Program services to which you are entitled in accordance with these Terms and Conditions.

(c)     You understand that as a registered player participating in the Program your child is entitled to certain Sports Injury Insurance benefits as detailed at AFL National Risk Protection Program | Marsh You accept that the level of cover provided to your child as a player is not intended to be comprehensive cover and does not include cover for expenses claimable from Medicare or the Medicare “Gap”, which cannot be insured through Personal Injury insurance in accordance with the Health Insurance Act 1973. These items may be claimable through Private Health insurance and it is strongly recommended that you investigate your personal insurance needs and consider the benefits of obtaining relevant insurance, for example Private Health insurance and Ambulance subscription etc. You understand that the Sports Injury insurance covers registered participants and registered volunteers only and does not cover parents, guardians or other people attending any activities that form part of the Program.

5. Cancellation, Refunds and Termination

(a)     The Fee is attributable to the delivery of the Superkick Minimum Session Commitment and Auskick Minimum Session Commitment (as applicable), and any Participant Benefits the child receives as outlined in item 3. To the extent that any sessions above the relevant minimum session commitment are not delivered, no compensation will be provided for that non-delivery.

(b)     Once you have registered a child in and paid for the applicable Program, unless required at law, a refund will only be provided to you in the following circumstances:

        (i) the child has a medical condition which prevents him or her from any further activity (a doctor’s certificate will be required); or

       (ii) the AFL deems that the Program has not been delivered to the reasonable expected standard.

Subject to item 4(c), the AFL is not liable to you for any loss or damage you suffer as a result of the Program or part of the Program being cancelled, postponed or changed.

(c)     The AFL will not replace your Participant Benefits if it lost, stolen or damaged.

(d)     The AFL may terminate your child’s participation in the Program on reasonable grounds at any time, including if your child’s behaviour interferes with another participant’s safety or enjoyment of the Program.

(e)     The AFL may refuse an Application or terminate an existing registration where a voucher (or other similar coupon) has been misappropriated to pay the Fee.

(f)     The AFL may, in its absolute discretion, change a Program or part of a Program, including dates, session times, durations and locations.

(g)     If you wish to cancel an Application that you have submitted, you must notify the AFL in writing (nab.auskick@afl.com.au/ nab.superkick@afl.com.au). Following the AFL’s confirmation to you of cancellation of your Application, the child the subject of the Application will have no entitlement to the Participant Benefits pack and will be ineligible for the NAB AFL Auskicker of the Year award.

6. Privacy

(a)     Personal information that the AFL collects on registration of a child in the Program pursuant to item 2 of these Terms and Conditions is used for the purpose of processing your Application. The AFL may also use this information to send you AFL and program related information or offers.

(b)     The AFL may also use your information or disclose it to AFL Clubs and third parties for the purposes of research, development and marketing in accordance with the AFL's Privacy Policy available at: AFL & AFL Club Privacy Policy - Play AFL.

7. Photographs

(a)     You consent to the AFL using your child’s name or image (including photographs) in any form or medium for general marketing and promotional activities related to the AFL, in accordance with all applicable privacy laws and the AFL’s Privacy Policy.

(b)     If you do not wish to consent to your child’s name and image being used, please notify your child’s Program Centre.

8. Player Code of Behaviour

By registering a child in the Program, you agree that the child understands and will adhere to the following (being the Player Code of Behaviour):

(a)     Play within the spirit of Australian football and by the rules of the Program.

(b)     Never argue with a coordinator, coach or volunteer parent or guardian.

(c)     Never bully or take unfair advantage of another participant in the Program.

(d)     Show respect to all participants in the Program regardless of their gender, race, ability, colour, religion, language, politics or national or ethnic origin.

9. Parents / Carers and Spectators Code of Conduct

Your child and other children and young people’s participation and enjoyment in AFL activities, programs or events are our primary consideration. By registering a child in the Program, you agree that you will adhere to the following conduct: (being the Parents, Guardians and Spectators Code of Conduct):

(a)     encouraging your child’s participation in a positive manner;
(b)     being present for the duration of any session or event that child attends at a Program centre. If you are unable to be present then you must ensure that there is another trusted adult (other than Program officials/personnel) that will oversee the child during the duration of the Program session or event;
(c)     not engaging in behaviour that discriminates against any other person on the basis of gender, race, ability, colour, religion, language, politics or national or ethnic origin in any way related to the Program;
(d)     not engaging in, or threatening to engage in, violent or physical confrontations with any other person in any way related to the Program;
(e)     not encouraging or inciting player violence, or any other similar breaches of the Program rules;
(f)      not engaging in behaviour that is not in the spirit of Australian football;
(g)     expressing your support of the Program by encouraging the participants and not engaging in behaviour designed to belittle, insult or intimidate participants, supporters or their officials;
(h)     never mocking or insult participants in the Program when they make a mistake or do not play well;
(i)      demonstrating good sportsmanship by respecting and acknowledging good play by all participants;
(j)      respecting and accepting the decisions of officials and not criticise or argue about decisions during or after any event held as part of the Program;
(k)      recognising the value and importance of volunteers;
(l)       refraining from smoking or consuming alcohol whilst spectating at any event associated with the Program; and
(m)     following any directions of an AFL or an AFL State or Territory employee, volunteer or other authorised Program ground staff, including any request to modify your behaviour or to leave the ground following a breach of these Terms and Conditions.

Breaches of these Terms and Conditions

Children’s and young people’s participation in and enjoyment of the Program is our primary consideration. As parents, guardians and spectators your role is to support this goal by encouraging your child’s participation in the Program in a positive manner. We actively encourage parents and guardians to get involved in the Program activities and assist where appropriate to achieve this goal.

Serious or ongoing breaches of these Terms and Conditions will not be tolerated. Those who breach these Terms and Conditions risk being asked to leave the event and/or being prohibited from attending future events.

If you witness or have a concern regarding child abuse, you must report this on the AFL’s safeguarding children and young people reporting platform (https://eafl.austfoot.com.au/afl-makeareport/#/landing) or to an appropriate person involved in the Program.

If you believe the child is in immediate danger, please call the Police (000).
